How does Retrospect go looking for folder labels?

Does it have to create a Smart Folder and use Finder APIs to see which folders have a label attached? I ask because I have and include for backup and an exclude for backup label attached to several directories but even Finder's smart folder cannot accurately show me the complete set of folders that have these labels. For instance I have /Users marked for backup but a Smart folder doesn't show that.

 

Now, Retrospect seems to only see a very small set of the folders I've marked for backup also.

 

I am using folder rather than file label criteria in my rules.

 

Now given that Finder cannot show me what's labelled I guess I'm not all that surprised that Retrospect cannot either.
